Your product's look often sells it before its features do: the curve of a bottle, the pattern on a fabric, the shape of a lamp, the form of a phone stand. Competitors can copy that look within weeks. Design registration in India gives you an exclusive right to that visual design for up to 15 years, and for startups and MSMEs it is one of the cheapest IP protections available.
This guide explains what can and cannot be registered, how to file, what it costs and how to avoid the mistakes that get applications rejected.

| Term | 10 years + 5-year extension = 15 years |
| Official fee | ₹1,000 (natural persons, startups, small entities); ₹4,000 (others) per application |
| Classification | Locarno International Classification |

A design is registrable if it is:
Examples: the shape of a perfume bottle, a printed fabric pattern, the outline of a chair, a toy's shape, the design of a product box.
| Not registrable | Why |
| Purely functional features or mechanical constructions | Protected, if at all, by patents |
| Trademarks or logos | Protected under the Trade Marks Act |
| Artistic works like paintings or sculptures (as such) | Protected by copyright |
| Designs already published or sold before filing | Lack novelty |
| Designs contrary to public order or morality | Excluded by law |
| Buildings and construction (generally) | Not treated as articles of manufacture |
The person or business that created the design, or has acquired it, can apply. Employers usually own designs created by employees during their work, subject to the employment terms.
DPIIT-recognised startups pay the reduced fee category for design registration, making filing affordable while they build products and attract investors or retail partners.
MSMEs registered under the MSMED Act generally qualify as small entities for reduced design fees. Keep your Udyam registration certificate ready as supporting proof for this category.
You may file directly or through a registered patent agent or advocate. If an agent files, a power of attorney is required, though applicants can also file themselves.
The design application form contains the applicant's details, article name, Locarno class and a statement of novelty. One application covers one design in one class for the article.
Clear drawings or photographs of the article from all relevant views: front, back, sides, top, bottom and perspective. Representations decide the scope of your design registration, so they matter most.
A short statement describing the novel visual features of the design. It should focus on shape, pattern or configuration, not on function, materials or technical advantages of the product.
For the reduced fee: a DPIIT startup certificate, or Udyam/MSME registration for small entities. Natural persons simply apply in their own name under the lower design fee.
Needed if a patent agent or advocate files on your behalf. It authorises them to act in all design registration proceedings, including replies and hearings before the Controller.
Search existing registered designs on IP India and look through marketplaces and the web. A pre-filing search saves fees and time, since prior similar designs are the commonest objection.
Identify the right Locarno class and sub-class for your article. Filing under the wrong class causes objections and can limit how far your registered design protects your product.
Prepare clean, consistent representations with no text, dimensions or technical notes. Each view should show the same design. Inconsistent views are a frequent reason for examination objections.
File Form-1 with representations and the official fee on the IP India e-filing portal. You receive an application number and filing date, which becomes your design protection date.
An examiner checks novelty, classification and formalities and may issue an examination report. Track progress through the design patent status check.
If objections are raised, reply with amendments or arguments within the deadline. The application must be put in order within 6 months of filing, extendable by 3 months.
Once cleared, the design is registered, a certificate is issued and the registration is published in the Patent Office Journal. Protection runs from the filing date for up to 15 years.
| Action | Natural person / startup / small entity | Others |
| Application for registration | ₹1,000 | ₹4,000 |
| Extension/renewal of term | ₹2,000 | ₹8,000 |
| Restoration of lapsed design | ₹1,000 | ₹4,000 |
| Cancellation petition | ₹1,500 | ₹6,000 |
Official fees under the Designs (Amendment) Rules, 2021. Professional fees, if you use an agent, are extra. See our detailed design registration fees guide.
You can stop others from making, selling or importing articles carrying your registered design, or an obvious imitation of it, in India for up to 15 years.
The Designs Act allows damages against infringers, with statutory compensation per contravention. A registered design makes enforcement far simpler than relying on unregistered rights.
Major e-commerce platforms act faster on takedown requests backed by a registration certificate. This is often the most practical everyday benefit for D2C brands.
Registered designs are business assets that can be licensed, assigned or valued during fundraising, adding credibility in investor due diligence and in retail or distribution negotiations.
