You filed a design application for your product's shape, packaging or pattern, and now you want to know where it stands. Searching for "design patent status" usually leads to search tools that show a status line but don't explain what it means or what you should do next.
A quick clarification first: India doesn't grant "design patents". Product appearance is protected by design registration under the Designs Act, 2000. The status-check process is the same whichever term you use.
This guide shows how to check your design application status on IP India, explains each status you might see, and tells you what action each one needs.
| Particular | Details |
| Law | Designs Act, 2000 and Designs Rules, 2001 |
| Office | Patent Office (Design Wing), Kolkata, under CGPDTM |
| Where to check status | IP India public search (search.ipindia.gov.in) → Design status |
| What you need | Design application number |
| Cost | Free |
| Protection term | 10 years, extendable by 5 years (15 years total) |
| Time to put application in order | Usually 6 months from filing, extendable by 3 months |
Go to the IP India website (ipindia.gov.in) and open the public search services. Choose the Design section, then the application status option for checking design registration status.
Type your design application number exactly as shown in the filing receipt. Design application numbers are long and specific, so copy them directly from the receipt to avoid "no record" errors.
Enter the captcha shown on screen and submit. If the page times out, refresh it and try again. The IP India servers can be slow during peak hours.
The result shows the application status, the filing date, the class, the applicant and, where available, the examination details. Note the date of the latest action and any deadline mentioned.
Where available, download the examination report or registration certificate. Save copies with your IP records, as you'll need them for replies, renewals or enforcement.
Can't find your number? Check the filing receipt email from IP India or ask your patent agent. Business owners often only have the agent's reference number, not the official application number.
Exact wording on the portal varies, but these are the stages you'll typically see:
| Status | What it means | What you should do |
| Application filed / New application | Received and numbered | Nothing yet; keep the receipt |
| Formalities check | Office checking forms, representations, fees | Fix any formality defects quickly |
| Under examination | Examiner is assessing novelty and registrability | Wait; avoid publishing new variants without advice |
| Objected / Examination report issued | Examiner raised objections | Reply before the deadline (see below) |
| Reply filed | Your response is under review | Prepare for a possible hearing |
| Hearing scheduled | Controller wants to hear you | Attend (online or in person) with arguments ready |
| Registered | Design is registered | Download the certificate; mark products; note the renewal date |
| Published | Registration published in the Patent Office Journal | Third parties can now see it; cancellation petitions possible |
| Abandoned / Deemed abandoned | Deadline missed | Ask whether restoration is possible |
| Refused | Controller rejected the application | Consider an appeal within the time allowed |
| Lapsed / Ceased | Renewal not paid | Apply for restoration within the allowed period |
Clean applications with good drawings can register within months. Applications with objections take longer. Protection runs from the date of filing, not the date of registration.
Common objections in Indian design examination include:
Reply within the deadline with amended drawings, clearer representations, a corrected class or legal arguments. Read our guide on design registration objection replies.
Go to IP India's public search, choose the design application status option, enter your application number and the captcha, and view the current status.
No. India protects product appearance through design registration under the Designs Act, 2000. "Design patent" is a US term, though people often use it in India.
It varies. Clean applications may register within months, while those with objections and hearings take longer. The application must be put in order within 6 months, extendable by 3 months.
The examiner has raised objections in an examination report. You must reply and fix the issues before the deadline, or the application may be treated as abandoned.
10 years from the filing date, extendable once by 5 years, for a maximum of 15 years.
You can search registered designs by other details, but the status check for a pending application needs the application number.
Checking design patent status is quick, but reading it correctly is what protects your product. Track deadlines, reply to objections on time, download your certificate once registered and diarise the renewal.
